[HATS] Texas Legislation - Where we stand 4-15-01

A public hearing before the House Transportation Committee has been set for
4-17-01 on  HB 1492 by Rep. Hardcastle.  Here is the URL:

When I met with Rep. Hardcastle earlier in the Session, he told me it was his
intention to exclude amateur radio.  He said he would send me a copy of the
Committee Substitute.  However, to date he has not done that; nor has a copy been
posted on the internet.

I obtained a copy of it from another office.  From this I can tell you it is my
opinion that amateur radio is excluded.  This is because it only pertains to

    "commercial wireless telecommunications services..."

That being the case, amateurs are excluded, and so are other non-commercial
services such as educational broadcasters.

A new Committee Substitute for HB 1148 by Rep. Cook has been formally passed by
the House County Affairs Committee, and printed for consideration of the House.
While this is different than the originally filed version, and his first Committee
Substitute version, which we have discussed, it does exclude amateur radio.

The new text says


     "Sec. 35.116.  EXCEPTIONS.  This subchapter does not apply to ... an
     antenna owned and operated by a federally licensed amateur radio station
     operator ... "

The new version of the text has now been posted on the internet, along with other
information.

HB 2722, by Rep. Raymond, is a housekeeping Bill concerning amateur license plates
for handicapped persons.  It provides that a handicapped amateur may have both his
call sign, and the handicapped symbol, on a license plate.  This was heard by the
House Transportation Committee, where it remains pending.
