                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to painting, marking, and lighting requirements for
 1-3     certain antenna structures.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  This Act may be called the LeClair-Jennings
Act.
 1-6           SECTION 2.  Subchapter B, Chapter 21, Transportation
Code, is
 1-7     amended by adding Section 21.069 to read as follows:
 1-8           Sec. 21.069.  PAINTING, MARKING, AND LIGHTING OF ANTENNA
 1-9     STRUCTURES.  (a)  The department shall adopt rules to establish
1-10     painting, marking, lighting, and other visibility requirements
for
1-11     antenna structures that are at least 50 feet but not more than
200
1-12     feet in height above ground level.
1-13           (b)  The rules adopted under this section shall be
similar to
1-14     the rules for antenna structures more than 200 feet in height
above
1-15     ground level under 47 C.F.R. Part 17, Subpart C, and its
subsequent
1-16     amendments.
1-17           (c)  In this section, "antenna structure" includes the
1-18     radiating or receiving system, its supporting structures, and
any
1-19     appurtenances mounted on the radiating or receiving system or
its
1-20     supporting structures.
1-21           SECTION 3. This Act takes effect September 1, 2001.
