I have just read the complete text of proposed HB1148 which you authored and
introduced to the House on February 1st during the 77th Regular Session.
While I understand and sympathize to some extent with the intent of the
bill, I must adamantly object to it in its present form for numerous
reasons. The bill as written is, at best, sophomoric and sets a new
standard for naivete. The broad nature of the proposed legislation places it
in direct conflict with Federal PRB-1 and equally importantly with the
recently legislated Texas Tower Bill (HB1345, 76th Regular Session) which
passed without a single vote of opposition in both the Texas Senate and
Texas House and was signed into law by Governor Bush on May 5, 1999 (Chapter
250, Local Government Code, Section 250.002).
In the very least, the bill should completely and unambiguously exempt
Amateur Radio installations of all types (mobile, portable, fixed, maritime,
permanent, temporary, air mobile, etc.) from any and all restrictions and
penalties that the bill provides. However, even with such exclusionary
language, the bill would likely produce a climate of confusion at the county
level that would be both burdensome and restrictive to Amateur Radio
operators and operations which provide unique services to the citizens of
Texas. I do not believe any of this is the intent of your bill but poorly
thought out actions can lead to such unintended consequences.
